OFFICIAL CONTEST RULES for the Dessert in a Cookie Recipe Contest
NO PURCHASE NECESSARY TO ENTER. Entries for this contest (the “Contest”) will be accepted during the period beginning at 12:01 a.m. ET on November 23, 2010 and ending at 11:59 p.m. ET on December 31, 2010 (the “Submission Period”). All entries must be received during the Submission Period. The Contest is open to legal residents of the United States and Canada (except Quebec), who are at least 18 years old. Contest void in Quebec, Puerto Rico and anywhere else where prohibited.
HOW TO ENTER: To participate in the contest, visit http://www.finecooking.com/contest/dessert-cookie-contest (the “WebSite”) during the Submission Period, and follow the directions to upload and submit a cookie recipe and photo (or a photo of the ingredients used). There is no limit to the number of entries. At the Website, participants will be required to log-in or register to complete an online entry form. All entries become the property of the Sponsors (hereinafter defined) and will not be returned.
Submission Requirements: Each photo submission that is entered into the Contest must meet ALL of the “Submission Requirements” set forth below (any Submission that, in Sponsor’s good faith judgment, violates the following criteria will be disqualified):
The Submission must be the submitting entrant’s original unmodified, previously unpublished work; The Submission must not include images or text that is obscene, pornographic, libelous, illegal, discriminative or otherwise objectionable; and The Submission must not include any corporate logos or any material that may infringe on the copyrights or intellectual property of any third parties.
The photograph of the Submission should be .jpg or .gif, up to 2 mb, 400 – 2,000 pixels. The Photograph of the Submission may not be digitally enhanced or altered.
By entering into this Contest, each entrant represents and warrants that (i) his or her Submission is entrant’s own original, previously unpublished work; (ii) The submission, the photo, is not subject to copyright.); (iii) that such Submission does not violate the rights of any third party or infringe or violate any law, and as of the date of the Submission, is not the subject of any actual or threatened litigation or claim; and (iv) the Submission does not and will not violate any applicable laws, and is not and will not be defamatory, libelous, pornographic or obscene. Note: Sponsor reserves the right, in its sole discretion, to disqualify any Submission in the Contest if Sponsor views the Submission as potentially infringing or otherwise a violation or potential violation of a third party’s rights or seek to secure permission for Sponsor’s benefit and allow the applicable Submission to remain in Contest. Sponsor reserves the right to disqualify any Submission in the Contest if it deems the Submission to be lacking in taste, quality, or to
be otherwise objectionable.
Submissions must be received by the end of the Submission Period. The Website’s database clock will be the official timekeeper for the Contest. Submissions become the exclusive property of Sponsor and will not be returned or acknowledged. Proof of submission is not considered proof of delivery or receipt of such Submission to Sponsor. Sponsor shall have no liability for any Submission that is lost, intercepted or not received by Sponsor, for any reason.
Posting of Submissions Online: Subject to Sponsor’s sole discretion, all Submissions that meet the Submission Requirements above, may be posted by Sponsor in a virtual gallery on the Website along with entrant’s name. From time to time during the Contest Entry Period, Sponsors may, in their sole discretion, choose to feature some of the submitted photos on the Website. Being featured on the Website is unrelated to the Judging Criteria (hereinafter defined).
PRIZES/VALUES: Grand Prize: $200 gift certificate for www.KingArthurFlour.com, Fine Cooking 2010 Archive DVD, Desserts 4 Today by Abigail Johnson Dodge, Fine Cooking Special Issue: Cookies, Brownies, Bars & More. Estimated prize value: $328.
Honorable Mention(s): $50 gift certificate for www.KingArthurFlour.com, Fine Cooking 2010 Archive DVD, Desserts 4 Today by Abigail Johnson Dodge, Fine Cooking Special Issue: Cookies, Brownies, Bars & More. Estimated prize value: $178.
The total approximate retail value of all the prizes is: $684.00 U.S. Sponsors reserve the right to substitute any prize for a prize of equal or greater value if such action becomes necessary.
TERMS/CONDITIONS: All federal, state/provincial and local laws and regulations apply. Void where prohibited. Prizes are non-transferable, not redeemable for cash, nor can requests to substitute one prize for another be honored. Each winner will be responsible for all applicable federal, state/provincial, and local taxes related to any prize. Sponsors shall not be responsible for any unsuccessful attempts to notify the winners. Employees, officers, and contractors (including immediate family members and members of the same household) of Sponsors, affiliated companies, subsidiaries, distributors, dealers, retailers, vendors of Sponsors, and all other entities associated with this promotion, are not eligible.
Each participant agrees to release and hold the Sponsors, their employees, officers, directors, shareholders, agents, representatives, and their subsidiaries, parent companies, or other affiliated companies harmless from any and all damages, losses, claims and/or liabilities arising out of his or her participation in the Contest or resulting from accepting or claiming any prize awarded hereunder. Unless indicated otherwise by checking the opt-out box on the
Website, participants acknowledge and agree that Sponsors may share personal information collected through the Contest from time to time with their subsidiaries, parent companies and affiliated companies, and that such information shall be used to contact participants for advertising and promotional purposes.
Notwithstanding the foregoing paragraph, participation in the Contest constitutes permission (except where prohibited by law) for the Sponsors to use any winner’s name, likeness, biographical information, photographs and any statements or remarks made about winning or participating in the Contest for advertising and promotional purposes (in any medium) without additional compensation.
WINNING: Judging Criteria. Among all qualified entries received, the judging organization (the “Judges”) shall select one Grand Prize, and two Honorable Mention prize winners on or about January 3, 2011. The Winners will be announced on or about January 7, 2011. All decisions by the Judges shall be final and binding.
The winners will be selected from all eligible Submissions using the following subjective judging criteria: 1) Creativity 50% 2) Execution 50%.
There will be one Grand Prize winner and two Honorable Mention prize winners. No more than the advertised number of prizes will be awarded.
Winners will be notified within 14 days of selection by telephone, mail or email.
CLAIMING PRIZES: The winner must sign and return an Affidavit of Eligibility and Liability/Publicity Release within thirty (30) days of notification, or his or her prize may be forfeited. Publicity Release not required where prohibited by law. Prizes will be delivered to each winner’s residence within thirty (30) days of receiving the Affidavit of Eligibility and Liability/Publicity Release. Winners will also be required to provide proof of age.
